General conditions of sale

Nail Clinique S.r.l., administrative and legal in Rome, Viale XXI Aprile n. 61-00162 is the owner of the http://www.sparkles.it site ("site").

The present general conditions of sale ("conditions") are governed by the consumer code (Legislative Decree No. 206/2005), section II of distance contracts (articles 50-67) and the rules governing electronic commerce (Decree No. 70/2003).

1) General conditions

The section called "Guide to the use of the site" is an integral and essential part of the General conditions.

The customer is invited to print or to save in the manner you prefer the general terms and conditions.

In case of changes in conditions, the order will apply the General conditions published on the site at the moment of sending of the order by the customer.

2) offer to the public

Products and prices presented in the site constitute an offer to the public in accordance with the arrangements provided for in the General conditions and in the same Site. The conditions of this offer applies only to purchases made on the site.

Purchase contracts concluded on the website are concluded with Nail Clinique S.r.l.

3) Prices

All prices are inclusive of VAT. Delivery charges/assembly are highlighted at the time of order.

To apply the price shown on the site at the time of conclusion of the order, without any consideration of possible price changes occurring later or earlier offerings.

4) Order

The customer concludes successfully order request and order confirmation if the site does not show any error message, and receives the notification email to the email address indicated in the registration.

The customer sends his order request, and then receives the response via email from Sparkles.it. That response includes the availability of requested items (or any waiting times), the choice of transport mode, the cost and time of transport and the order number. The response includes the link to the webpage dedicated to customer orders. Access to this page is bound to the user code and personal Password.

The customer can see in the Web page dedicated to his order, the availability of requested items (or any waiting times), the choice of transport mode, the cost and time of transport and the order number.

The order number must be used by the customer for any communication with Nail Clinique S.r.l.

The contract is concluded upon confirmation of the customer of all information related to your order. The confirmation is done through the selection of "confirm" command in the Web page on the customer's orders. Confirmation involves sending a notification e-mail to the customer.

The customer undertakes the chore to verify the correctness of the data and to communicate immediately to Nail Clinique S.r.l. corrections. Possible additional charges determined by errors in the data not reported in a timely manner, will be charged to the Customer.

It is possible that you may experience occasional delays in the availability of articles than the scheduled date. In this case Nail Clinique S.r.l. will communicate this promptly to the client.

5) methods of payment

Payment can be made online by credit card with the modalities set out in the website.

Together with the communication from the confirmation of order, the amount corresponding to the items purchased and transport services will be charged to the customer.

6) modalities and delivery costs

Nail Clinique S.r.l. delivery only in the areas defined in the site. Zones and rates for delivery services are available on the site.

In case of changes in delivery rates, order apply rates published on the site at the time of sending the request to order by the customer.

Nail Clinique S.r.l. issuing invoice items purchased, delivering it along with the articles of the order to the holder of the order. For the issue of the invoice authentic information provided by the customer will be used. No variation of the data will be possible after the issue of the invoice itself.

Delivery expenses are charged to the customer and adequately highlighted in the order.

No liability can be attributed to Nail Clinique S.r.l. in case of delay in delivery.

The delivery will take place in accordance with the procedures indicated in the order.

The carrier shall make a delivery attempt of the products to the address indicated by the customer. In case the attempt is not successful, the articles will remain in stock at the warehouse of the carrier.

For each day of delay in delivery or withdrawal attributable to the customer (e.g. absence of Reviews at the time of delivery, non-collection by the customer)their will be charged a deposit fee of Eur 2.50 per day, payable to the customer.

At the time of delivery, the customer is obliged to check that the packaging is not damaged, nor wet or otherwise altered, including the materials of closure (tape or strapping, metal).

In case the damage is evident, the customer can refuse to accept the articles themselves, which will be returned to Nail Clinique S.r.l. at no cost for the Customer.

Once signed the document of delivery, the customer cannot oppose any dispute about the external characteristics of the products delivered.

Any issues related to physical integrity, of the products received should be reported promptly to Nail Clinique S.r.l. so that guarantee conditions can be activated.

7) right of withdrawal

If the customer is a consumer he has the rights under art. 64 of the code of consumption within the limits provided by this legislation and has therefore the right to withdraw from the contract of purchase for any reason, without explanation and without any penalty, in the manner hereinafter provided.

The right of withdrawal is exercised by sending-within 30 (thirty) calendar days from the date of receipt of the products-a written communication by registered mail A/r. addressed to:

The communication can be anticipated-within the same period-by telegram, e-mail (address assistenza@sparkles.it) provided it is confirmed by registered letter a/r within 48 hours.

The communication of withdrawal will have to specify a willingness to withdraw from the purchase and the article or articles for which it intends to exercise the right of withdrawal, attaching a copy of the invoice.

In case withdrawal is exercised by means of written communication, the return of articles will be within 30 (thirty) calendar days from the date of receipt thereof, and delivered  at Nail Clinique S.r.l., Via Farnesina 336, 00194 Rome.

The right of withdrawal is still subject to the following conditions:

1) the right applies to individual items purchased in their entirety;

2) article purchased must be undamaged and returned in original packaging, complete in all its parts (including packaging and ancillary documentation);

3) shipping costs relating to the refund of the product shall be charged to the customer; the shipment is under the full responsibility of the customer.

If the right of withdrawal has been properly exercised, Nail Clinique S.r.l. will refund the client the whole amount already paid, within 30 (thirty) days after receipt of the notice of withdrawal. The amount refunded will be net of costs for the delivery of the articles.

8) Warranties

All items sold by Nail Clinique S.r.l. enjoy the guarantees of the law and guarantees trade from time to time specified on the site.

9) personal data

Customer data is processed by Nail Clinique S.r.l. in accordance with the regulations regarding the protection of personal data.

10) communications

Any communication may be addressed to Nail Clinique S.r.l., at the addresses above.

11) jurisdiction

Any disputes will be resolved before the competent judicial authority under the applicable legislation in Italy.

Nail Clinique S.r.l. want, to inform you that we will treat the personal data you have supplied during registration, for the following purposes:

1) conduct of service of on-line purchases;

You have the right to oppose, for legitimate reasons the processing and sending promotional materials or commercial and market research.
